Bankruptcy and Receiverships

Our firm represents trustees, secured and unsecured creditors, acquiring entities, and debtors in bankruptcy cases and related adversary proceedings. Our firm has significant experience in Chapter 11 reorganizations, liquidations of corporations and partnerships, loan work-outs, and debt restructuring. Members of our firm have served as lead counsel for the debtors in the following Chapter 11 cases: New Florida Properties Corp.; CHS Electronics, Inc.; Florida West Airlines, Inc.; South Motors Companies; Beverage Canners International Corp.; CopperCom.Inc.; FB Air, Inc.; and Reptron Electronics Corp. Members of our firm have served as counsel for the bankruptcy trustees in the Omni Capital Group and Premium Sales bankruptcies. Members of our firm have also served as counsel for official committees of note holders, indenture trustees, and unsecured creditors in the following noteworthy Chapter 11 cases: Braniff, Inc.; Atlas Air, Inc.; Model Imperial, Inc.; SeaEscape Cruises, Inc.; Bertram-Trojan, Inc.; and Arrow Air, Inc.

Members of our firm have more than 50 years of combined experience in federal and state receivership matters. Members of our firm have served as federal and state equity receivers, and have also represented equity receivers, in fraud cases brought by the Securities and Exchange Commission (SEC), the Commodities Futures Trading Commission (CFTC), the Federal Trade Commission (FTC), and the Florida Department of Financial Services. The cases where members of our firm have acted as and/or represented federal equity receivers at the request of the SEC include the cases of Pension Fund of America, Inc., et al. ($130 million), Viatical Capital, Inc., et al. ($60 million), Medco, Inc. and SunState FX, Inc. A member of our firm also serves as the Conservator of the $250 million Future First Financial Group, Inc. viatical proceeding initiated by the Florida Department of Financial Services.

Class Actions and Enforcement Proceedings

Our firm prosecutes and defends class actions, and defends against related enforcement actions. Our firm represents securities issuers, officers and directors, venture capital firms, hedge funds, investment bankers, broker-dealers, and attorneys and accountants, in individual actions, class actions, derivative lawsuits, and enforcement proceedings brought by federal and state regulatory agencies.

Insurance

Our firm represents insurers regarding coverage issues and litigates disputes over the interpretation of a variety of insurance contracts, including title, property, casualty, officer and director liability, accountant liability, legal liability, general liability, and aviation.

Labor and Employment

Our firm represents clients in all aspects of personnel-related legal matters. This includes: employment discrimination, both agency and civil employment litigation, traditional labor work, investigations of employee complaints and whistleblower claims, workforce issues involving high-level strategic planning and collective bargaining, and other areas of regulation, such as OSHA, the Uniformed Services Employment and Reemployment Rights Act, the Family Medical Leave Act, and state and federal wage and hour regulation. Our firm has considerable expertise in defending employers against significant class action and multi-plaintiff cases, including individual and class action claims under Title VII (sex, race, national origin, and religious discrimination and retaliation), the ADEA (age discrimination), the ADA (disability discrimination), the Fair Labor Standard Act (wage and hour claims), and the FMLA (family leave). Our firm also represents individuals in negotiating employment agreements and pursuing legal claims against employers, such as major Fair Labor Standards Act collective action and state law wage-hour class actions, and employment tort and breach-of-contract cases.
